Texas Health Insurance for the Disabled

Sometimes residents of Texas who have physical or mental challenges find it difficult to find health insurance. And sometimes even those that do get health insurance in Texas aren’t getting the coverage they really need. Some of the problems that disabled people face include outrageous insurance premiums, unreasonable policy cancellations, claims are unjustly or improperly denied. It may often be more difficult for the people who are already dealing with challenges to take this unfair treatment on top of everything else they are dealing with.
Everyone is entitled to the same rights under the law when it comes to health insurance in Texas. In fact, if anything, disabled people are and should be entitled to extra protection under the law. These people have the right to take legal action against any insurance carrier that has not treated them appropriately. Disabled people have every right to the same health benefits as everyone and in some cases even more so.
To be considered “disabled” under the law does not necessarily mean having zero functioning, for example a “legally blind” person may still have some sight, or a physically disabled person may be able to walk with the use of a walker. Being disabled generally means having an impaired ability to see, hear, walk or reason, as a few examples. Sadly, it is far too common for people who already face additional challenges in life because of their disability to also have to deal with discrimination, but when it comes to health insurance in Texas, a disabled person doesn’t have to take it.
Sometimes a person with a disability will be labeled by the insurance company as having a “pre-existing medical condition” and may have to pay a higher premium for health insurance in Texas. Some people, however, feel that this is unjust and some have been successful in fighting this in court. Other insurance companies put limitations on what they will and will not cover for the disabled person and they may need to fight for their rights.
Some disabilities don’t seem to pose any kind of problem when it comes to getting health insurance in Texas. Vision or hearing loss issues don’t always raise the same red flags with the insurance companies that certain other disabilities do.
When it comes to health insurance in Texas, state laws prohibit an insurance company from denying service or claims for a person just because they are disabled. In some cases, the insurance company has proven that covering specific disabilities causes too much loss for them and many disabled people are automatically eligible for Medicaid just based on the type of disability they have. A person who is disabled has the right to receive a written explanation of why they were denied health insurance with a particular insurance company.
The Americans with Disabilities Act was put into place in order to keep disabled people from being discriminated against for things like employment and insurance coverage. Although things have improved in the last ten years, there is still much to be done. Until society comes around and completely eliminates discrimination of all kinds, disabled people will have to continue to fight for their rights, including their right to fair health insurance in Texas.

Individuals who dont purchase health insurance may lose their tax refunds according to IRS Commissioner Doug Shulman. After acknowledging the recently passed health-care bill limits the agencys options for enforcing the individual mandate, Shulman told reporters that the most likely way to penalize individuals that dont comply is by reducing or confiscating their tax refunds. Speaking at the National Press Club on Monday, Shulman downplayed the IRSs role in enforcing the recent overhaul of the health insurance industry by claiming the agency would not aggressively target individuals who dont purchase coverage. He noted that the health-care bill expressly forbids the agency from freezing bank accounts, seizing assets or pursuing criminal charges, but when pressed said the IRS would most likely use tax refund offsets to penalize those that dont comply with the mandate. The IRS uses refund offsets to collect from individuals that owe the federal government a delinquent debt. These are not the kinds of things we send agents out about, Shulman said. These are things where you get a letter from us. Congress was very careful to make sure there was nothing too punitive in this bill. Many reports have claimed that enforcement of the individual mandate will be non-existent, but Shulmans answers indicate differently. It depends on the program. Some mail them to the patient, other to the doctor. You can call each programs phone# and ask. I've had patients on meds that fit in both categories. I don't do mental health, so I don't know about your two meds.

It is so sad and upsetting when I hear people say that Obama is a communist or a socialist because they are puttng a label on him, judging him, and stereotyping him. I’ve even heard it on Christian television and radio. I thought those were the people that cared about people and helping them but I hear a lot of Christian radio and tv judging our president and calling him names. It’s not right.
Republicans, health insurance companies are feeding this idea that Obama is trying to socialize the health care system–Obama wants ALL people to have access to health care—it is something good. If you read between the lines, you would realize that nationalized health care would eliminate the government programs for needy people ie, medicare, medicaid, section 8, food stamps. Earning minimum wage would be enough for a person to have a place to live and be able to eat. But when a Dr. visit costs three days pay, or filling a cavity costs 4 days pay, or a prescription costs a week’s pay, you give up. You are going to be on the streets anyway.
A lot of people are afraid to get treatment not because they’ll be turned away, but because they’ll be chased for the money later. The more ill you are, the worse that bill is likely to be.
We need the public option. The insurance companies will screw us without it.
The Republicans want to help the rich and screw the poor. They dont care about the majority of people.
They want to cut taxes for the rich, but then there is less money for social programs for the poor and middle class. Republicans don’t want a public option, because there insurance buddies wouldn’t be able to make as much money.
To the blue dog democrats, dont be traitors. Get back to your democratic roots.
This situation is NOT uncommon, it happens every day. People die every day because of NO medical care, but the republicans don’t give a dam.
